1. OVERVIEW & ACCEPTANCE OF TERMS
Welcome to Modern Blend Boutique (“Company,” “we,” “us,” or “our”).
By accessing our website, browsing our merchandise, or purchasing products, you agree to these Terms and Conditions, subject to applicable law.
These Terms govern purchases, product representations, final-sale conditions, customer responsibilities, dispute-resolution procedures, and applicable legal rights.
We reserve the right to update these Terms periodically. Changes will apply prospectively unless otherwise permitted by law.
2. PRODUCT ACCURACY & REPRESENTATIONS
Modern Blend Boutique strives to provide accurate product descriptions, authentic supplier photographs, sizing information, and merchandise specifications.
Customers are encouraged to review all product information before purchasing.
Minor differences in color appearance may result from lighting, photography, or device settings.
Such differences do not authorize the delivery of materially incorrect or misrepresented merchandise.
3. AI-GENERATED IMAGERY DISCLOSURE
Modern Blend Boutique may use artificial intelligence to generate or enhance model photographs, styling demonstrations, lifestyle backgrounds, and promotional images.
AI-generated images are intended for styling inspiration and visual presentation.
They do not replace actual product specifications or authorize material misrepresentation.
Customers are encouraged to review authentic merchandise photographs, sizing charts, fabric information, and written product descriptions before completing purchases.
4. FINAL SALE & NO-RETURN POLICY
ALL SALES ARE FINAL.
Modern Blend Boutique does not accept returns, exchanges, or refunds for buyer’s remorse, changes of mind, personal preferences, or incorrect sizing selections when the merchandise materially conforms to the advertised product description.
Exception: If merchandise is incorrect, materially defective, or materially different from its advertised description, Modern Blend Boutique will investigate the concern and provide an appropriate remedy in accordance with applicable law.
Nothing in this section eliminates nonwaivable consumer rights.
5. ORDER ACCEPTANCE & PAYMENT
All orders are subject to payment authorization, merchandise availability, and order acceptance.
Modern Blend Boutique reserves the right to cancel or refuse orders for legitimate reasons, including suspected fraud, pricing errors, or merchandise unavailability, subject to applicable law.
Customers agree to provide accurate billing, shipping, and contact information.
If an accepted order cannot be fulfilled, Modern Blend Boutique will provide an appropriate refund or other lawful resolution.
6. SHIPPING, DELIVERY, FULFILLMENT & TRANSACTION VERIFICATION
6.1. DOMESTIC & INTERNATIONAL FULFILLMENT
Modern Blend Boutique works with domestic and international suppliers, manufacturers, and fulfillment partners to process and deliver customer orders.
Merchandise may ship from locations within or outside the United States. Shipping estimates are provided in good faith and may vary due to customs processing, carrier delays, supplier operations, or unforeseen circumstances.
Modern Blend Boutique remains responsible for its obligations under applicable consumer protection laws, regardless of the fulfillment provider involved.
6.2. CUSTOMER SHIPPING INFORMATION & ADDRESS ACCURACY
Customers are responsible for providing complete and accurate shipping information at checkout, including applicable apartment numbers, postal codes, and contact details.
Address corrections must be requested promptly and cannot be guaranteed once an order enters fulfillment.
In the event of a delivery discrepancy, Modern Blend Boutique may review checkout records, accepted address modifications, shipping labels, and carrier documentation to determine the appropriate resolution.
6.3. SHIPPING DELAYS & DELIVERY OBLIGATIONS
Shipping and delivery timelines may vary depending on merchandise availability, supplier location, and carrier operations.
Modern Blend Boutique will make reasonable efforts to communicate significant fulfillment delays.
Where applicable law requires notification, customer consent to a revised shipping date, cancellation rights, or a refund, Modern Blend Boutique will comply with those requirements.
6.4. DELIVERY VERIFICATION & TRANSACTION RECORDS
Modern Blend Boutique may maintain relevant transaction and fulfillment documentation for order verification, customer support, fraud prevention, delivery investigations, and payment-dispute resolution.
Available records may include order confirmations, shipping labels, carrier tracking information, delivery confirmations, delivery photographs, signature records, carrier investigation findings, and customer communications.
Records will be handled in accordance with applicable privacy laws and Modern Blend Boutique’s Privacy Policy.
6.5. MISSING PACKAGES, INCORRECT DELIVERY & THIRD-PARTY RECEIPT
Customers who report missing merchandise, incorrect delivery, or packages marked delivered but not received are encouraged to contact Modern Blend Boutique promptly.
The Company may investigate these reports using available order records, shipping documentation, and carrier information.
Where appropriate, Modern Blend Boutique may request a carrier investigation to verify the delivery circumstances.
Carrier delivery confirmation may constitute supporting evidence but does not automatically establish delivery to the correct destination.
Each claim will be evaluated individually based on available evidence, applicable law, and relevant payment-network requirements.
6.6. LOST SHIPMENTS, SUPPLIER ERRORS & CUSTOMER REMEDIES
Modern Blend Boutique may coordinate with suppliers, fulfillment providers, and shipping carriers to investigate lost shipments, incorrect merchandise, damaged goods, or fulfillment errors.
Where merchandise cannot be delivered or an order cannot be fulfilled as agreed, Modern Blend Boutique will provide an appropriate remedy consistent with applicable law, including any legally required refund.
Supplier or carrier errors do not automatically eliminate Modern Blend Boutique’s obligations to customers.
6.7. DELIVERY-RELATED PAYMENT DISPUTES & MERCHANT RIGHTS
Modern Blend Boutique reserves the right to contest inaccurate or unsupported delivery-related payment disputes through its authorized payment processor.
Where relevant and available, the Company may submit order confirmations, customer-provided shipping information, shipping labels, carrier tracking histories, delivery verification, carrier investigation findings, and customer communications.
All evidence will be considered under applicable payment-network procedures. Nothing in this provision restricts lawful customer dispute rights or guarantees a particular outcome.
6.8. RESERVATION OF RIGHTS & CONSUMER PROTECTIONS
Modern Blend Boutique reserves the right to investigate disputed deliveries, preserve relevant transaction documentation, verify shipping information, and assert lawful contractual or statutory defenses.
All shipping, delivery, and fulfillment matters remain subject to applicable consumer protection laws.
Nothing in this section shall limit or waive any right, obligation, or remedy that cannot lawfully be excluded or waived.
7. CUSTOMER INSPECTION & 48-HOUR REPORTING REQUEST
7.1. CUSTOMER INSPECTION UPON DELIVERY
Modern Blend Boutique encourages customers to inspect their merchandise promptly upon receipt to verify that the items correspond to their order and are free from visible damage, defects, or fulfillment errors.
Customers are encouraged to review the product’s size, color, quantity, condition, and overall conformity with the product description provided at the time of purchase.
7.2. REQUESTED 48-HOUR NOTIFICATION PERIOD
To facilitate timely investigations and efficient resolutions, customers are requested to notify Modern Blend Boutique of any visible damage, incorrect merchandise, missing items, or material product discrepancies within 48 hours of receiving their order.
This notification period is a customer-service request intended to assist with supplier coordination, shipping investigations, and preservation of relevant evidence.
The 48-hour reporting period does not eliminate, restrict, or waive any customer rights or remedies available under applicable law.
7.3. DOCUMENTATION OF PRODUCT CONCERNS
Customers reporting a product concern are encouraged to provide their order number, a description of the issue, and relevant supporting documentation when reasonably available.
Supporting documentation may include photographs of the merchandise, packaging, shipping labels, visible defects, or discrepancies between the merchandise received and the original product description.
Modern Blend Boutique may review relevant product listings, order confirmations, fulfillment records, supplier information, and customer communications to evaluate the reported concern.
7.4. PRODUCT DESCRIPTION & AI-GENERATED IMAGERY DISCREPANCIES
Modern Blend Boutique may utilize AI-generated imagery for product presentation, styling inspiration, and visual merchandising, as disclosed in Section 3 of these Terms and Conditions.
Customers who believe merchandise materially differs from its advertised description, specifications, or representations are encouraged to contact Modern Blend Boutique with details of the discrepancy.
The Company will assess such concerns based on the product information available at the time of purchase, the merchandise actually received, and applicable consumer protection laws.
The use of AI-generated imagery does not eliminate Modern Blend Boutique’s responsibility to provide accurate, nonmisleading product representations.
7.5. INVESTIGATION & GOOD-FAITH RESOLUTION
Modern Blend Boutique reserves the right to investigate reported merchandise discrepancies using available transaction records, product information, customer documentation, and supplier communications.
Where a product is defective, materially different from its description, or incorrectly fulfilled, the Company will provide an appropriate resolution consistent with applicable law.
Depending on the circumstances, resolutions may include replacement merchandise, correction of the fulfillment error, or a refund where required.
7.6. FINAL SALE POLICY & STATUTORY CUSTOMER RIGHTS
Modern Blend Boutique maintains a Final Sale Policy for purchases, as further described in Section 4 of these Terms and Conditions.
The Final Sale Policy generally excludes discretionary returns or exchanges based solely on personal preference, changes of mind, or dissatisfaction unrelated to a qualifying product or fulfillment issue.
However, the Final Sale Policy does not override legally required remedies for defective merchandise, material misrepresentation, incorrect fulfillment, or other circumstances protected by applicable law.
7.7. RESERVATION OF RIGHTS & CONSUMER PROTECTION
Modern Blend Boutique reserves the right to review customer complaints, verify available transaction information, investigate reported product discrepancies, and maintain relevant documentation for legitimate business purposes.
Customers retain all applicable consumer protection rights, including legally required remedies and lawful payment-dispute rights.
Nothing in this Section 7 shall be interpreted as creating an absolute 48-hour deadline for asserting legally protected claims or as waiving any right or remedy that cannot lawfully be waived.
8. CUSTOMER COOPERATION & GOOD-FAITH RESOLUTION
8.1. COMMITMENT TO FAIR CUSTOMER RESOLUTION
Modern Blend Boutique is committed to maintaining transparent business practices, professional customer service, and fair resolution procedures.
When a customer reports a concern involving merchandise, order fulfillment, delivery, or product representations, the Company will make reasonable efforts to investigate the circumstances and identify an appropriate resolution.
All complaints will be evaluated in good faith, based on available evidence, applicable store policies, and relevant consumer protection laws.
8.2. CUSTOMER COMMUNICATION & COOPERATION
Customers are encouraged to contact Modern Blend Boutique promptly when experiencing an order-related concern.
To assist with an accurate investigation, customers may be requested to provide relevant information, including their order number, a description of the concern, photographs when reasonably available, and supporting documentation directly related to the reported issue.
Modern Blend Boutique may request reasonable clarification or additional information when necessary to verify the circumstances of a complaint.
Customer cooperation is encouraged to facilitate efficient resolution; however, failure to provide optional documentation does not automatically invalidate a legitimate complaint or eliminate legally protected rights.
8.3. MERCHANT INVESTIGATION & DOCUMENTATION
Modern Blend Boutique reserves the right to review relevant transaction and fulfillment records when investigating customer concerns.
Such records may include order confirmations, product descriptions, customer communications, shipping documentation, delivery confirmations, supplier records, and previous resolution attempts.
The Company may also communicate with authorized suppliers, fulfillment providers, or shipping carriers when reasonably necessary to investigate an order-related discrepancy.
All investigations will be conducted in accordance with applicable law and the Company’s Privacy Policy.
8.4. OPPORTUNITY FOR VOLUNTARY RESOLUTION
Modern Blend Boutique encourages customers to allow the Company a reasonable opportunity to investigate and address reported concerns before initiating a payment dispute.
Depending on the circumstances, the Company may offer an appropriate resolution, including correction of an order, replacement merchandise, or a refund when required by applicable law.
Any proposed resolution will be evaluated according to the nature of the complaint, available evidence, applicable policies, and legal obligations.
Customers are not required to contact Modern Blend Boutique before exercising lawful chargeback or payment-dispute rights.
8.5. ACCURATE REPRESENTATIONS & GOOD-FAITH COMMUNICATION
Modern Blend Boutique expects all parties involved in an order-related investigation to communicate truthfully and respectfully.
The Company may document material inconsistencies between customer statements, order records, shipping information, and other relevant evidence.
Where a payment dispute arises, Modern Blend Boutique may provide accurate and relevant transaction documentation to its authorized payment processor in accordance with applicable payment-network procedures.
An inconsistency, incomplete statement, or disputed allegation does not automatically establish customer fraud or intentional misrepresentation.
8.6. PAYMENT DISPUTES & PRESERVATION OF EVIDENCE
When a customer initiates a payment dispute, Modern Blend Boutique reserves the right to preserve and submit relevant transaction records, customer communications, fulfillment documentation, and evidence of attempted resolution.
Such documentation may be submitted to the appropriate payment processor or financial institution when permitted and relevant to the dispute.
The Company will not knowingly submit fabricated, misleading, or materially altered evidence.
Payment disputes will be evaluated under applicable financial institution and card-network rules, and no provision of these Terms guarantees a particular outcome.
8.7. FINAL SALE POLICY & CUSTOMER REMEDIES
Modern Blend Boutique’s Final Sale Policy remains applicable to discretionary returns and exchanges, as described in Section 4 of these Terms and Conditions.
However, the Company will evaluate qualifying complaints involving defective merchandise, incorrect fulfillment, material product discrepancies, or other legally protected circumstances.
The Final Sale Policy does not eliminate remedies required under applicable law.
8.8. RESERVATION OF RIGHTS & CONSUMER PROTECTIONS
Modern Blend Boutique reserves the right to investigate complaints, maintain accurate business records, communicate with authorized fulfillment and payment-service providers, and assert lawful contractual or statutory defenses.
Nothing in this section requires customers to surrender payment-dispute rights, accept an inadequate resolution, or waive legally protected remedies.
All customer complaints and resolution procedures remain subject to applicable consumer protection laws. Nothing in this Section 8 shall restrict or waive any right or remedy that cannot lawfully be restricted or waived.
9. ARIZONA COMMERCIAL LAW — NOTICE OF BREACH
A.R.S. § 47-2607(C)(1): Where applicable, a buyer who has accepted goods must notify the seller of an alleged breach within a reasonable time after discovering or when the buyer should have discovered the breach.
Modern Blend Boutique reserves the right to assert any legally available defense concerning failure to provide notice required under applicable law.
Whether notice was provided within a reasonable time depends on the circumstances and governing law.
10. ARIZONA COMMERCIAL LAW — BURDEN OF PROOF
A.R.S. § 47-2607(D): Where applicable, a buyer bears the burden of establishing a breach concerning accepted goods.
Modern Blend Boutique reserves the right to invoke this statutory allocation of the burden of proof in appropriate legal proceedings.
This provision does not independently determine payment-card chargeback outcomes.
11. EXPRESS WARRANTIES & SELLER’S RIGHT TO CURE
A.R.S. § 47-2313 — Express Warranties: Qualifying product descriptions, samples, models, and affirmations of fact may create express warranties.
A.R.S. § 47-2508 — Seller’s Right to Cure: Where statutory conditions are satisfied, a seller may have an opportunity to correct a nonconforming tender or delivery.
Modern Blend Boutique reserves applicable statutory rights while honoring remedies required by law.
12. PAYMENT DISPUTES & CHARGEBACK DEFENSE
Modern Blend Boutique reserves the right to contest inaccurate, unsupported, or procedurally defective payment disputes through its authorized payment processor.
Relevant evidence may include:
- Original product descriptions and photographs.
- AI-generated imagery disclosures.
- Product specifications and supplier documentation.
- Order confirmations and shipping records.
- Customer communications and resolution offers.
- Return requests and attempted returns.
Visa Dispute Condition 13.3: Where applicable, Modern Blend Boutique may request review under Visa’s procedures concerning merchandise allegedly not as described or defective.
Other payment networks may impose different requirements and exceptions.
Nothing in this section restricts lawful payment disputes or guarantees a favorable dispute determination.
13. SUPPLIER ERRORS & CUSTOMER REMEDIES
If merchandise is materially incorrect, defective, or inconsistent with applicable product representations because of a supplier error, Modern Blend Boutique will investigate and provide an appropriate remedy in accordance with applicable law.
Modern Blend Boutique separately reserves the right to pursue reimbursement or contractual remedies against the responsible supplier.
14. INTELLECTUAL PROPERTY
Website content, branding, logos, original photographs, graphics, and written materials owned by Modern Blend Boutique are protected under applicable intellectual property laws.
Unauthorized reproduction or commercial use of protected content is prohibited, except as permitted by law.
Third-party materials remain the property of their respective owners.
15. LIMITATION OF LIABILITY
To the extent permitted by applicable law, Modern Blend Boutique shall not be liable for indirect, incidental, or consequential damages arising from use of the website or purchase of merchandise.
Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded.
16. GOVERNING LAW & RESERVATION OF RIGHTS
To the extent permitted by applicable law, these Terms shall be governed by the laws of the State of Arizona.
Mandatory consumer protections applicable in other jurisdictions remain effective where required.
Modern Blend Boutique reserves all lawful contractual and statutory rights, defenses, and remedies available under applicable law.

Customers may contact Modern Blend Boutique through the contact information published on our website regarding orders, merchandise concerns, returns, or other inquiries.
We encourage customers to contact us promptly so that concerns may be investigated and resolved efficiently.
18. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain effective to the extent permitted by law.
19. FRAUD PREVENTION, PAYMENT AUTHORIZATION & CHARGEBACK PROTECTION
Payment Authorization: By placing an order, the purchaser represents and warrants that they are authorized to use the selected payment method and that the information provided is accurate.
Transaction Verification: Modern Blend Boutique reserves the right to review transactions for suspected fraudulent activity, unauthorized payments, or material inconsistencies. Orders may be delayed, declined, or canceled when credible fraud concerns arise, subject to applicable law.
Electronic Transaction Evidence: Modern Blend Boutique and its authorized payment providers may preserve relevant order confirmations, transaction timestamps, payment authentication results, fraud-screening information, customer communications, and fulfillment documentation.
Fraudulent Transaction Disputes: Modern Blend Boutique reserves the right to contest inaccurate or unsupported unauthorized-transaction claims through its payment processor. Evidence may be submitted under applicable payment-network procedures, including Visa Dispute Condition 10.4 where relevant.
Legal Rights: A chargeback alone does not establish fraud. Nothing in this section restricts legitimate disputes, waives consumer protections, or guarantees a particular dispute outcome.
19. ENTIRE AGREEMENT
These Terms, together with applicable store policies and disclosures, constitute the agreement governing purchases from Modern Blend Boutique, subject to applicable law.
In the event of a conflict, mandatory applicable law shall control.
